1. Parties to this Agreement
This user agreement (referred to hereinafter as “the Agreement”) contains the terms and conditions of the use of the marttiini.fi webshop (referred to hereinafter as “the Service”) owned by Marttiini Ltd (referred to hereinafter as “Marttiini”). When a person (referred to hereinafter as “the User”) orders a product/ products, he or she agrees to this Agreement.

2. Use of the Service
You must be eighteen (18) or older to order products from the Service.
Everything in the Service, including, but not limited to, images, drawings, sounds, films, graphics and text, is protected by worldwide copyright and other proprietary laws and treaty provisions. Marttiini grants you a limited license to access and make personal use of this site. It is forbidden to download, (except where specifically invited through the use of the word “Downloads”), to duplicate, to sell or to modify, any portion of this site without express written authorization from Marttiini.
3. User Responsibilities
The User accepts responsibility for all activities that occur under his/her account or password. The User is solely responsible for maintaining the security of his/her password.
The User warrants to Marttiini that the information he/she provides during the ordering process (and any notification of change of such information) is true and correct.
The User warrants that he/she is over 18 years old.
4. Gathering and use of personal data
Marttiini is committed to respecting the User’s privacy. Marttiini is the sole owner of the information collected on marttiini.fi. The information is used entirely and only by Marttiini, except in cases where Marttiini uses third party agents to perform certain functions, such as credit card processing, delivering packages and fulfilling orders. In those cases, Marttiini provides only the information necessary for the performance of those specific functions.
Marttiini does not transfer any information given by the User to a third party for any other purpose than processing the order. Marttiini will not sell, share or rent this information to any other entity for any reason.
Marttiini reserves the right to transfer the information provided by the User to the authorities in the case of infringement of laws and violation of good practice by the User.
The User has the right to examine, change and delete information about him/herself from the register. Upon request we provide any site visitor who establishes his or her identity to our satisfaction with access to information that we have collected from them.
5. Information Security Policy
All customer information records will be secured both within the net as well as outside it.
All information stored outside the online service is also subject to due care. The supplied information will only be processed by designated Marttiini employees processing the respective tasks. The information will be gathered in a central database and the servers that maintain them are protected by appropriate firewalls, passwords and up-to date technical means. The servers are located in areas, which are locked and that include passage control system. Possible outside service providers are bound by agreements that require confidentiality and maintaining appropriate security measures.

Card payments in our webstore are provided by Maksuturva Group Ltd in cooperation with Solinor Oy and Bambora AB. Maksuturva Group Ltd submits card payment transactions to Bambora AB, which has acquiring-agreements with the international card companies (Mastercard and Visa). Card numbers are not recorded in Maksuturva Group Ltd’s systems; the card data is processed by the technical service provider Solinor Oy. Solinor Oy has the highest “PCI DSS Level 1” security certification as per the PCI DSS –security standard developed by the international card companies. For its own activities, Maksuturva Group Ltd is certified to the PCI DSS –standard.

Marttiini will not submit any information supplied by the customers to third parties. We only demand from the Users information essential to ordering of and billing for our products. E-mail addresses and phone numbers are required to confirm the orders and contacting the customer in case of possible problem situations. Marttiini gathers data only from the Users themselves.
Cookies do not retrieve any other information from your computer, pass on viruses or capture your e-mail address.
To use our website efficiently, you have to accept cookies. Normally browsers are set to accept cookies. If your browser doesn´t accept cookies you can easily change the settings in your browser´s preferences.
9. Ordering and Payment Terms
After you have ordered your product, you will receive an automatic confirmation by email that your order has been received and accepted. The order confirmation will state the products you ordered and their price.
A binding sales agreement between the User and Marttiini is reached when the User receives an order confirmation e-mail.
Unless otherwise agreed by Marttiini, payment must be received by prior to the acceptance of an order.
10. Product Prices
The product price is the price displayed for the item on the Service at the time of ordering.
Delivery charges are additional to the product price. Deliveries are sent through the Finnish Post (Itella). If the delivery includes many different products, which have various delivery times, the deliveries will be combined into one shipment and it will be sent when all the products are ready for delivery.
The delivery prices are fixed irrespective of the size of the shipment; the price will differ, however, depending on the delivery country as following:

All the product prices and delivery charges are displayd in euros (EUR).

International customers are responsible for all taxes, duties and fees required by their customs services, which are levied once the package reaches your country. Additional charges for customs clearance must be borne by you; Marttiini has no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; the User should contact the respective local customs office for further information.
The delivery time of the products will depend on each product. The delivery time will depend on the availability of the product and the shipping destination. The products are shipped from the factory within a week after the confirmation of the order. If the product is temporarily sold out, the service will mention that the product is not available. The final delivery time will depend on the shipping destination and the shipping schedules of the post.
Marttiini shall not be liable for delays in performing or failure to perform according to this Agreement or failure to fulfil any obligations hereunder, which are directly attributable to causes beyond Marttiini’s reasonable control (force majeur), including, but not limited to, acts of God, fires, strikes, labor disputes, war, acts or interventions by any governmental authority, failure of a common carrier, supplier, hardware, software, browser, or communications equipment, or network failure, congestion, or malfunction.
If the order includes many different products with different delivery times, the orders will be combined in one delivery and sent when all the products are ready.
Marttiini takes responsibility over the loss and damage of the product that has occurred during the delivery.
When ordering you need to be aware of customs risks associated with certain types of knives as you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. This is why it is important to be aware of the knife laws of your country or province. We will do everything we can to make sure your item reaches you, but Marttiini is not responsible for orders delayed, seized or refused by your customs service. This is a responsibility and risk you agree to when you order.
Marttiini will not falsify package contents or value on customs forms. Customs forms for all international packages list the value of your order's contents by product type.
If the User notices that the package is damaged before opening it, please inform the party who delivered it. If the User has opened the package before seeing the damage, please inform Marttiini’s customer service. When the User returns products that do not have any damage, please note that the User shall be responsible for the damage that may occur while the product is in sent back to Marttiini.
12. Cancellation and Returns
The User has a fourteen-day (14) right to return or exchange a product according to Finnish consumer protection legislation. Specially engraved knives can only be returned if the graving has been performed erroneously.
The customer has a right to return a product if:
- The order has been cancelled according to the terms and conditions by notifying the customer service firstname.lastname@example.org within 14 days of delivery;
- The product has not been used,
- The product is in the condition that the customer received it in and all the parts of the product are included in the package and
- The product has been repackaged into its original package.
The product must be returned as soon as possible after cancellation. If you wish to return the product, please contact Marttiini’s customer service by email at email@example.com
When returning products the User will be responsible for the risk of damages.
Marttiini shall reimburse the costs that arise out of the shipment. Only shipments from Finland.
Faulty goods or items damaged during shipping have to be reported to Marttiini’s customer service as soon as possible after receiving the product. Marttiini will strive to replace the faulty or damaged item, but if this is not possible, the customer will be reimbursed with the full amount of costs.
The fault or the sustained damage must be documented by due process and with appropriate photographs. Marttiini will not deliver a replacement before the fault or damage has been confirmed.
Please follow the instructions given by the Marttiini customer service when dealing with reclaim issues.
The price of the returned items will be refunded on the User’s credit card. The reimbursement will take place as soon as Marttiini has received and inspected the returned item. This will result in a delay of some time before the refund is visible in bank records.
A three (3) year limited warranty against manufacturing defects is offered on all standard furniture (materials and construction). Normal attrition and collateral damage is not covered by the warranty.

15. Changes to the Service and this Agreement
Marttiini reserves the right to make changes to the Service, to policies, and this User Agreement at any time.
16. Jurisdiction and Dispute Settlement
This User Agreement will be interpreted, construed and enforced in all respects in accordance with the laws of the Republic of Finland. Any contractual disputes are primarily settled through negotiations. Secondarily disputes are settled at the Rovaniemi District Court in Finland.
